Terms and Conditions for Listings and Visitors of The Mom Archive

Welcome to The Mom Archive, South Africa’s first comprehensive online directory and community platform designed to simplify parenthood. Our mission is to connect parents with trusted products, resources, services, and places, offering support and inspiration for navigating parenting with confidence. As an exposure-based platform, we prioritize showcasing businesses that align with our community’s needs rather than driving sales.

1. Acceptance of Terms

By accessing and using The Mom Archive, you agree to these Terms and Conditions. If you do not agree, please do not use our website.

2. Changes to Terms

We may update these terms from time to time. Any changes will be posted on this page with an updated effective date. Your continued use of the website after any changes constitutes your acceptance of the new terms.

3. User Registration

To access certain features of the site, you may need to register for an account. You agree to provide accurate and complete information during registration and to update such information to keep it accurate, current, and complete.

4. User Conduct

You agree not to engage in any of the following prohibited activities:

• Using the site for any illegal purpose.
• Posting false or misleading information.
• Harassing, threatening, or defaming others.
• Uploading viruses or harmful code.

5. Business Listings

Businesses listed on The Mom Archive provide their own information, photos, and links to market their services. All submitted content is subject to approval by The Mom Archive to ensure it meets our standards and aligns with our mission.

6. Subscription Cancellation

Clients must sign up for a minimum term of three (3) months. Cancellations can be submitted via the account area after the three (3) month period has passed. Once a cancellation has been submitted, no additional billing will occur and your listing will remain active until it’s expiry.

7. Subscription Payment and Listings

Monthly failed subscriptions will result in the automatic removal of the business listing from the system until the payment is successfully processed. All subscription payments are facilitated by our payment partner, PayFast.

8. Intellectual Property

All content on The Mom Archive, including text, graphics, logos, and software, is the property of The Mom Archive or its licensors and is protected by copyright, trademark, and other intellectual property laws. Unauthorized use of any content may violate copyright, trademark, and other laws.

9. Disclaimer of Liability for Listings

The Mom Archive provides a directory of listings for user convenience. However, we do not endorse any businesses or services listed on our site. We are not responsible for any issues that may arise from transactions made between users and these businesses, including but not limited to product quality, service delivery, or any disputes that may occur.

10. Indemnification

You agree to indemnify and hold harmless The Mom Archive, its affiliates, and their respective employees, officers, and directors from any claims, losses, liabilities, damages, and expenses (including reasonable attorneys’ fees) arising out of your use of the site or violation of these terms.

11. Ownership and Communication

12. Governing Law

These terms shall be governed by and construed in accordance with the laws of Western Cape, South Africa. Any disputes arising from these terms shall be resolved in the courts of Western Cape, South Africa.
